Union Cabinet recommends President's rule in Maharashtra: Report

The development comes after Shiv Sena failed to form the government in the state within the 24-hour deadline given by the governor

 

NEW DELHI : The Union Cabinet on Tuesday recommended President's rule in Maharashtra where no political party has been able to form a government after the assembly polls last month.

The Bharatiya Janata Party (BJP), the largest party in the state with 105 seats, had earlier decided against staking claim to the form the government in the 288-seat assembly.

The BJP and Shiv Sena had fought the elections last month in an alliance. Once the results came out, Shiv Sena insisted on a 50-50 seat sharing formula including its man as a chief minister for half the term. This wasn’t acceptable to the BJP which got almost double the number of Shiv Sena’s seats.

Unrelenting in its bid to appoint Aaditya Thackeray, its chief Uddhav’s son, as chief minister or one of its own men in the post, Shiv Sena then hobnobbed with the Congress and Sharad Pawar’s Nationalist Congress Party (NCP) to form the government.

State governor Bhagat Singh Koshyari gave the regional party only 24 hours to prove its majority. While NCP was willing to support the Shiv Sena, it was Congress president Sonia Gandhi and many of her party members who were reluctant to support a party they have never seen eye-to-eye with. The Congress letter of support for the regional outfit never came even as NCP was willing to lend a helping hand.

The governor also called NCP leaders like Ajit Pawar for a meeting to get a sense of the political situation.

TV channels have reported that Shiv Sena has approached Congress leader and Supreme Court lawyer Kapil Sibal to explore the possibility of approaching the apex court against President’s rule. The Shiv Sena is miffed that it got only 24 hours to get the letters of support from the other parties while the BJP was given five days to prove its majority.

Maharashtra governor Bhagat Singh Koshyari confirmed on the Raj Bhavan's official Twitter handle having recommended the President's Rule. He said that his actions were as per the law.

Governor has acted in hot haste: Shiv Sena

The Shiv Sena, in a writ petition in the Supreme Court against the Maharashtra governor's recommendation to reportedly  impose President Rule's in the state, called the decision an "arbitrary, unconstitutional, unreasonable, capricious, and malafide".

The Shiv Sena on Monday had asked the governor for three days' time to stake a claim to form the government, but the request was denied. In the petition, Shiv Sena said that Koshyari had "in hot haste refused to grant even three days’ time"

Shiv Sena seeks urgent SC hearing against Governor's refusal to grant extention

Shiv Sena has sought an urgent hearing in the case agains bid to impose President's Rule in Maharashtra. Shiv Sena said, "Governor wrongfully declined to give three days time". Shiv Sena MLA Anil Parab is a co-petitioner in the case. However, the Supreme Court has not said anything about hearing the case on an urgent basis.

 

Advocate Sunil Fernandez files plea on behalf of Shiv Sena

Shiv Sena has filed a petition in the Supreme Court challenging the Maharashtra governor's decision to not extend the time given to the party to prove their ability to form the government. Advocate Sunil Fernandez has filed the plea for Shiv Sena, ANI reported.
