A Pakistan special court issued a bizarre but apparently symbolic order for former military ruler Pervez Musharraf on Thursday, saying his corpse should be dragged to parliament and hang for three days if he dies before his execution.

The court sentenced Musharraf to death on Tuesday after finding him guilty of high treason for subverting the constitution in 2007.

Thursday's announcement came after the government said it had found fault with the sentence, apparently taking sides in a split between the military and the judiciary, and the general's lawyers said he plans to appeal.

The court directed law enforcers to apprehend Musharraf, currently receiving medical treatment in Dubai, to ensure the death sentence is carried out.

 

But if found dead beforehand, "his corpse (should) be dragged to D-Chowk, Islamabad, Pakistan, and be hanged for three days", it said.

The chowk, or roundabout, is just outside parliament.

Legal experts termed the instructions unconstitutional, even if symbolic.

There is only one precedent - a court sentenced a serial killer to hanging at a public place and his body to be cut into 100 pieces in front of the families of the victims. The sentence was never carried out.

Information Minister Firdous Ashiq Awan said on Wednesday the government's legal team had found "gaps and weaknesses" in the original death sentence after lawyers briefed Prime Minister Imran Khan about the case.

Musharraf, 76, who was tried and sentenced in absentia, said in Dubai the charges against him were politically motivated.

Musharraf's lawyers said they will appeal against the sentence to the Supreme Court, which the government, the complainant in the treason case, is unlikely to oppose.

The verdict sent shudders through the military, which has ruled Pakistan for about half the country's history. The army accused the court of ignoring legal processes and defended Musharraf's patriotism. It said the ruling had caused "pain and anguish" in the ranks.

 

Attorney General Anwar Mansoor Khan has said Musharraf wasn't given a fair trial, taking the army line in a standoff between the judiciary and the military.

Tensions arose after Supreme Court struck down a three-year extension in service given by the government to army chief General Qamar Javed Bajwa.

Musharraf seized power in a coup in 1999 and later ruled as president.

In November 2007, Musharraf suspended the constitution and imposed emergency rule, prompting protests. He resigned in 2008 to avoid the threat of impeachment.

When Nawaz Sharif, whom Musharraf deposed in 1999, was re-elected prime minister in 2013, he initiated a treason trial against Musharraf and in 2014 he was charged with high treason.

"This case was taken up only due to a personal vendetta by some people against me," Musharraf said in a video statement from his hospital bed in Dubai.

Musharraf travelled to Dubai after a travel ban was lifted in 2016 and he has refused to appear before the court, despite multiple orders.

In its 167-page detailed judgement authored by Peshawar High Court Chief Justice Waqar Ahmad Seth, who headed the three-member bench, the special court on Thursday said the “convict be hanged by his neck till he dies on each count as per charge”.

Furious over a special court’s verdict to drag Gen (retd.) Pervez Musharraf’s corpse to the Parliament and hang it for three days, the Pakistan government on Thursday said that it will move to the Supreme Judicial Council to unseat the “mentally unfit” head of the tribunal.

In its 167-page detailed judgement authored by Peshawar High Court Chief Justice Waqar Ahmad Seth, who headed the three-member bench, the special court on Thursday said the “convict be hanged by his neck till he dies on each count as per charge”.

“We direct the law enforcement agencies to strive their level best to apprehend the fugitive/convict and to ensure that the punishment is inflicted as per law and if found dead, his corpse be dragged to the D-Chowk, Islamabad, Pakistan and be hanged for 03 days,” he wrote.

D-Chowk, or Democracy Chowk is close to several important government buildings - the Presidency, the Prime Minister’s office, the Parliament, and the Supreme Court.

Soon after the detailed judgment, Prime Minister Imran Khan consulted his legal team and the decision of the meeting was announced at a press conference by his top aides.

Law Minister Farogh Naseem said that the judgment showed that Justice Seth was “mentally unfit” as he suggested to hang the dead body of Musharraf if he dies before his execution.

He said such a punishment was against any law of Pakistan.

“The federal government has decided to go to the Supreme Judicial Council as the government believes that such a person cannot be a judge of any High and Supreme Court. If a judge gives such a judgment then such a judge is mentally unfit and incompetent,” Naseem said.

The Supreme Judicial Council is the only body to remove a judge of high and supreme court in Pakistan.

Naseem said that government would also ask the higher judiciary to stop Justice Seth from performing his duties because it is an “unprecedented and despicable observation by the judge.” Shehzad Akbar, another aide of Khan, said that the judgment was against all norms of law and the government would not only seek unseating of the judge Seth but also file appeal against the verdict.

“We have decided to file appeal against the verdict,” he said.

He also said that the judgment was made in haste and the accused was not given the right of fair trial.

Earlier, Military spokesman Major General Asif Ghafoor said Army chief General Qamar Javed Bajwa and Prime Minister Imran Khan had a detailed meeting on the conviction of Gen (retd.) Musharraf and took some important decisions.

The detailed judgement angered the army, which said the verdict was against all human, religious and civilizational values.

“The apprehensions about the short verdict given on Dec 17 have been proved right by the detailed judgment of today. The decision of today and especially the words used in it are against the humanity, religion, civilization and any other value,” Ghafoor said.

The detailed judgement came hours after Musharraf raised serious questions on his trial and said the verdict was based on some people’s “personal animosity” towards him.

“Some people in high offices misused their authority to target one individual,” he said, in an apparent reference to Chief Justice of Pakistan Asif Saeed Khosa.

Khosa, who is retiring on Friday, last month said that the post-2009 judiciary had convicted one prime minster (Yousuf Raza Gilani); disqualified another (Nawaz Sharif); and was soon going to decide the treason case against a former army chief (Musharraf).
