A Delhi court on Tuesday issued a death warrant against all the four convicts in the December 2012 gangrape case and said that they would be executed on January 22 at 7 am. The verdict came after the parents of the victim moved the court seeking to expedite the procedure to hang all the four convicted in the case and also demanded issuance of death warrant against them.

 

దేశ వ్యాప్తంగా సంచలనం సృష్టించిన నిర్భయ అత్యాచార ఘటనపై ఢిల్లీ కోర్టు కీలక నిర్ణయం తీసుకుంది. ఇప్పటికే తీహార్‌ జైలులో శిక్ష అనుభవిస్తున్న నలుగురు దోషులకు శిక్ష అమలు తేదీని ఖరారు చేసింది. జనవరి 22న ఉదయం 7 గంటలలోపు ఉరిశిక్ష అమలు చేయాలని పటియాల హౌస్‌కోర్టు ఆదేశించింది. ఈ మేరకు విచారణలో భాగంగా మంగళవారం డెత్‌ వారెంట్‌ను జారీచేసింది. కాగా దోషులను వెంటనే శిక్షించాలని కోరుతూ నిర్భయ తల్లి ఆశాదేవీ పటియాల కోర్టును ఆశ్రయించిన విషయం తెలిసిందే. దీనిపై విచారించిన న్యాయస్థానం దోషులకు (ముఖేష్‌, పవన్‌గుప్తా, అక్షయ్‌కుమార్‌, వినయ్‌శర్మ) డెత్‌ వారెంట్‌ను జారీచేసింది. దీంతో ఏడేళ్ల నిరీక్షణకు న్యాయస్థానం ఎట్టకేలకు తెరదించింది.

On Tuesday, the Patiala House Court issued the death warrant for execution of the 4 convicts in the Nirbhaya rape and murder case. They will be hanged till death on January 22 at 7 am. Until then, the convicts can exercise the remaining legal remedies. All the convicts were produced before the court via video-conferencing. Earlier, the court reserved its order after hearing the arguments from the counsels of all the parties in the case. In December, the matter was adjourned, giving time to the rapists of Nirbhaya to exercise their remaining legal remedies.

After a court issued death warrant against the four convicts in the Nirbhaya case, convict Vinay Sharma has filed a curative petition in the Supreme Court.

Days after a court issued the death warrants against all four convicts in 2012 Nirbhaya Delhi gang-rape case, one of the convicts on Thursday filed a curative petition in the Supreme Court.

Convict Vinay Sharma’s lawyer AP Singh said a curative petition in the Supreme Court seeking a stay on the death penalty. Four convicts in the sensational 2012 Nirbhaya Gang rape and murder case will be hanged on January 22 at 7 am in Tihar jail.

In the petition, the lawyer said the SC should have considered that Vinay was only 19 years old at the time of the incident. Young age and socio-economic background should have been considered as mitigating factors.

The SC has commuted death penalty to life imprisonment in 17 other cases of rape and murder, including that of minors. Same relief should be granted to Vinay, the plea mentions.

The Delhi court had earlier issued the death warrants against the four death row convicts -- Mukesh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Kumar Singh (31).

A curative petition is the last legal recourse available to a convict and it is generally considered in-chamber.

The Supreme Court had on December 18 dismissed the plea of Akshay seeking review of its decision, saying review petition is not "re-hearing of appeal over and over again" and it had already considered the mitigating and aggravating circumstances while upholding the death penalty.

 

The 23-year-old paramedic student, referred to as Nirbhaya, was gang raped and brutally assaulted on the intervening night of December 16-17, 2012 inside a moving bus in south Delhi by six persons before being thrown out on the road.

She died on December 29, 2012 at Mount Elizabeth Hospital in Singapore.

On July 9 last year, the apex court had dismissed the review pleas filed by the other three convicts in the case, saying no grounds have been made out by them for review of the 2017 verdict.

One of the six accused in the case, Ram Singh, allegedly committed suicide in the Tihar Jail here.

A juvenile, who was among the accused, was convicted by a juvenile justice board and was released from a reformation home after serving a three-year term.

if ii petition accept avuthe.. case will run for few more years.. Elago delay aiyyidhi ani life imprison vestharu - same like rajiv g@ndhi killers case..

Nirbhaya case: SC to hear curative plea on Jan. 14

A bench of Justices NV Ramana, Arun Mishra, RF Nariman, R Banumathi and Ashok Bhushan will hear the curative petitions filed by Vinay Sharma and Mukesh at 1.45 p.m.

A five-judge Bench led by Justice N.V. Ramana will examine the curative petitions filed by two Nirbhaya gang-rape case convicts, Vinay Sharma and Mukesh, on January 14.

The other judges on the Bench are Justices Arun Mishra, Rohinton Nariman, R. Banumathi and Ashok Bhushan. The judges would examine the petitions in their chambers at 1.45 p.m. and decide to either accept or reject them.

The curative petitions were filed by both convicts on January 9. The petitions came just days after a Delhi sessions court scheduled the execution of all the four convicts for January 22, at Tihar Jail.

Sharma and Mukesh, in separate curative petitions, said there had been a sea change in the death penalty jurisprudence since their convictions. They argued that ignoring the subsequent changes in the law against death penalty would be a “gross miscarriage of justice”.

Curative is a rare remedy devised by a Constitution Bench in its judgment in the Rupa Ashok Hurra case in 2002.

A party can take only two limited grounds in a curative petition — one, that he was not heard by the court before the adverse judgment was passed, and two, that the judge was biased.

A curative petition, which follows the dismissal of a review petition, is the last legal avenue open for convicts in the Supreme Court. Sharma was the first among the four convicts to file a curative plea.

In his plea, Sharma said the Supreme Court had commuted the death penalty in several rape and murder cases since 2017, when the apex court first confirmed the death penalty for the Nirbhaya convicts.

“After the pronouncement of judgment in 2017, there have been as many as 17 cases involving rape and murder in which various three-judge Benches of the Supreme Court have commuted the sentence of death,” the petitioner contended.

The Supreme Court had recently dismissed a review petition filed by another one of the four condemned men, Akshay Singh, to review its May 5, 2017, judgment confirming the death penalty in the Nirbhaya case.

The court had also refused Singh’s plea to grant him three weeks’ time to file a mercy petition before the President of India.

A Bench led by Justice R. Banumathi had said it was open for the Nirbhaya convicts to avail whatever time the law prescribes for the purpose of filing mercy plea.

Singh (33), Mukesh (30), Pawan Gupta (23) and Sharma (24) had brutally gang-raped a 23-year-old paramedical student in a moving bus on the intervening night of December 16-17, 2012. She died of her injuries a few days later.

The case shocked the nation and led to the tightening of anti-rape laws. Rape, especially gang-rape, is now a capital crime.

if murder is wrong, then state sanctioned murder is also wrong. simple.
