With its passing, Virginia has become the 38th state to ratify the amendment, which was first proposed in 1923. The ERA guarantees that the “equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.” The deadline to approve the amendment passed in 1982, shrouding the measure’s future in legal uncertainty.
