Nirbhaya Case Convicts to be Hanged on March 3 as Delhi Court Issues Fresh Death Warrants

This is the third time that death warrants have been issued in the Nirbhaya case, after the previous two were stayed because of pending legal options of the convicts.

New Delhi: A Delhi court has issued fresh death warrants against the four convicts in the 2012 Delhi gang-rape and murder case and set a new date for their hanging: March 3 at 6am.

This is the third time that death warrants have been issued, after the previous two were stayed because of pending legal options of the convicts - Mukesh Singh, Pawan Gupta, Vinay Sharma and Akshay Kumar.

 
 
 

Reacting to the verdict, victim's mother Asha Devi told News18 that she hoped this date is final. "I am satisfied with this verdict. (I) never lost faith. Finally, we have another date and (I) hope they'll be hanged," she said outside the court premises.

Additional Session Judge Dharmender Rana at the Patiala House court set the date for the execution after the Supreme Court granted liberty to the authorities to approach the trial court for issuance of a fresh death warrant as all legal remedies moved by the convicts were disposed of.

During the hearing, the counsel of one of the convicts - Pawan Gupta - told the court that he wanted to move a curative petition before the Supreme Court and the mercy plea against the death sentence before the President.

Gupta is the only one among the four convicts who has not yet filed the curative petition - the last legal remedy available to a person, which is decided in-chamber. He also has the option of filing a mercy plea.

The court had earlier in the day reserved the order after hearings during which Mukesh Singh told the court that he does not want to be represented by advocate Vrinda Grover. The court then appointed advocate Ravi Qazi to represent Mukesh.

The court was also informed that another death row convict, Vinay Sharma, is on hunger strike in Tihar jail. Vinay was assaulted in jail and has head injuries, his lawyer told the court, adding that he was suffering from acute mental illness and hence the death sentence cannot be carried out. The court directed the Tihar jail superintendent to take appropriate care of Vinay as per law.

Akshay Kumar's counsel informed court that he has prepared fresh mercy petition to be moved before the President, as the previous one prepared by his parents "was incomplete."

The case pertains to the gang-rape and brutalising of a 23-year-old paramedical student in a moving bus on the night of December 16, 2012, by six people including a juvenile in Delhi. She died at a Singapore hospital a few days later. One of the five adults accused, Ram Singh, had allegedly committed suicide in the Tihar Jail during the trial of the case.

The four men convicted of rape and murder of the 23-year-old paramedic will be hanged on March 3 at 6 am, a Delhi court said on Monday. This is the third black warrant issued by the court in this case.

“The death warrant would be now executed on March 3 at 6 am,” judge Dharmender Rana said in a one-line order pronounced on Monday afternoon. The judge had earlier in the day reserved his order after arguments by both sides.

As soon as the judge announced the new death warrant, there were claps in the court.

The court was hearing the petition filed by the parents of the victim for issuance of fresh death warrant. The parents of the 23-year-old had moved court after the seven-day period given by the Delhi high court to the convicts to exhaust their legal remedies expired on February 12.

““I am not very happy as this is the third time that death warrant has been issued. We have struggled so much, so I am satisfied that death warrant has been issued finally. I hope they (convicts) will be executed on March 3,” said the victim’s mother Asha Devi.

At the hearing today, Tihar Jail’s law officer had handed over a status report to the court.

 

Special Public Prosecutor Rajiv Mohan apprised the court about the current status of the case and also stated that three out of four convicts have already exhausted their legal remedies.

And as of date, there is no petition pending in any court, Mohan said, arguing that death warrant can be issued.

 

He also mentioned that Delhi High Court had given seven-day time to the convicts and that period is over.

The other of one of the convicts, Mukesh Kumar, started crying and pleaded that his son’s death sentence should be commuted to life sentence.

Additional Sessions Judge Dharmender Rana was also informed by AP Singh, the lawyer of the convicts, that one of them, Vinay Sharma, is on hunger strike in Tihar jail since February 11.

 

The parents of the 2012 Delhi gangrape case victim, through their lawyer, had told the court during the hearing on Thursday that patience of the society is being tested by this case.

The date of execution for the four convicts - Mukesh Kumar Singh (32), Pawan Gupta (25), Vinay Kumar Sharma (26) and Akshay Kumar (31) - was first fixed for January 22 in Tihar jail, was later postponed for 6 am on February 1 by a January 17 court order.

The physiotherapy intern was gang-raped and savagely assaulted on the night of December 16, 2012, in a moving bus in South Delhi. She died of her injuries a fortnight later in a Singapore hospital.

 

Six people - the four convicts, Ram Singh and a juvenile - were named as accused.

The trial of the five adult men began in a special fast-track court in March 2013.

Ram Singh, the prime accused, committed suicide by hanging himself in Tihar jail days after the trial began. The juvenile, who was said to be the most brutal of the attackers, was put in a correctional home for three years.

He was released in 2015 and sent to an undisclosed location amid concerns over a threat to his life. He, when released, was 20 years old.

Mukesh, Vinay, Akshay and Pawan were sentenced to death in September 2013 by the trial court.

There is still a chance that two of the four, may file mercy petetion just around the dead line time..

This new deathw arrant date is good as long as there are no more appeals, or else give or take another fortnight atleast...

Nirbhaya Case Convict On Hunger Strike After Exhausting All Legal Options

After exhausting every legal remedy, one of the four convicts sentenced to death in the Nirbhaya case has started hunger strike in Delhi's Tihar jail. This information was part of the status report to the court, presented by the Tihar jail authorities today. Three of the convicts have exhausted the legal options available to them, the jail authorities said.

Convict Mukesh Singh, meanwhile, told the court that he did not wish to be represented by court-appointed advocate Vrinda Grover.

Convict Vinay Sharma went on hunger strike after his petition against President Ram Nath Kovind's rejection of his mercy plea was turned down by the Supreme Court last week.

The death row convict had claimed that the President had not factored in his mental illness following torture in jail. The Centre had produced a medical report dated February 12, which showed that he was mentally sound.

The trial court is hearing a plea from the parents of the woman and the Delhi government, seeking fresh death warrants for the four convicts.

The woman's parents have accused the legal system of being lenient to the perpetrators of the horrific gangrape and torture that had shocked the nation.

"It seems the judge has some sort of affection for the accused," said the father of the woman. "They are supporting them (the convicts). They don't want to hand out punishment," the woman's mother had alleged, holding a protest outside the court when the hearing was postponed.

The convicts have been using every legal loophole to delay the execution. Last month, their lawyer AP Singh had bragged to the woman's mother that "the hanging will never happen".

The four convicts, along with two others -- one of them a minor -- had gang-raped the young woman and tortured her with an iron rod in a moving bus on the night of December 16, 2012.

After fighting for life for nearly two weeks, she died on December 29 at a hospital in Singapore.

One of the assailants, just short of 18 when the crime was committed, was released after spending three years in a reform home. The main accused, Ram Singh, was found hanging in jail.

The brutality of the attack had outraged the nation bringing thousands on the streets in protest, which led to key changes in the law and security system.

On February 5, the High Court gave the convicts one week’s time to exhaust their legal remedies and also rejected the government’s prayer to allow them to be executed separately.

After the SC proceeding, the parents of the victim in the case and the Delhi government Tuesday approached a Delhi court, seeking issuance of fresh death warrants against the four death-row convicts. Tihar Jail authorities also filed a status report before the court, stating that no legal option was preferred by any of the convicts in last seven-day-period, granted by the High Court.

Nope none is allowed anthuke before sun rise they complete the procedure...only concerned officials and doctors allowed..
