  • A new rule: The United States will today begin enforcing a regulation that could prevent legal immigrants, including Indians on H-1B visa, from becoming permanent residents if they seek public benefits like food stamps, housing vouchers and Medicaid.
  • What it says: The new policy requires immigrants applying for permanent residency to show that they won't be "public charges”, or a burden on the country. If the authorities decide that an applicant may become a public charge in future, legal residency could be denied.
  • Why now? The final rule published on August 14, 2019 was originally scheduled to come into effect on October 15 last year but could not be implemented due to various court rulings. A Supreme Court ruling last week lifted the final remaining injunction.
  • Who it affects: According to a 2018 Migration Policy Institute Report, 61% of non-citizen Bangladeshi families, 48% of non-citizen Pakistani and 11% of non-citizen Indian families receive public benefits that would be scrutinised under the rule.
