Nirbhaya Rape Case: Pawan Gupta, 25, was the only convict in the case who had not exhausted his legal options of a curative petition.

The Supreme Court today dismissed a curative petition by Pawan Gupta, one of the four convicts in the gang-rape and murder of a 23-year-old medical student in Delhi dubbed "Nirbhaya" by the media, a day before their scheduled date of hanging. He has filed a mercy plea before President Ram Nath Kovind.

Pawan Gupta, 25, was the only convict in the case who had not exhausted his legal options of a curative petition. In his plea filed last week, he had urged the court that his death sentence be changed to life imprisonment.

No case is made out for re-examining the conviction and the punishment of the convict, said a five-judge bench headed by Justice NV Ramana.

Hours after Pawan Gupta's curative petition was dismissed by the top court, he filed a mercy petition before the President. The mercy petitions of the three other convicts - Mukesh Kumar Singh, Vinay Kumar Sharma and Akshay Kumar - have already been dismissed by the President.

The Supreme Court had earlier dismissed the pleas filed by Mukesh Kumar Singh and Vinay Kumar Sharma that challenged the rejection of their mercy petitions. Akshay Kumar has not yet challenged the rejection of his mercy petition.

The four convicts, along with two others - one of them a minor - had gang-raped the young woman and tortured her with an iron rod on the night of December 16, 2012. She died on December 29 at a hospital in Singapore.

One of the attackers, just short of 18 when the crime was committed, was released after spending three years at a reform home. The main accused, Ram Singh, was found hanging in jail.

The brutality of the attack had outraged the nation bringing thousands on the streets in protest, which led to key changes in the law and security system.

The Union Home Ministry has received the mercy petition of Pawan Kumar Gupta, one of the four men facing the gallows in the 2012 Nirbhaya gang rape and murder case, officials said on Monday.

The ministry will forward the petition to President Ram Nath Kovind for his consideration and decision.

A 23-year-old woman, who came to be known as ''Nirbhaya'' (fearless), was gang raped and savagely assaulted in a moving bus in south Delhi on December 16, 2012. She died days later, on December 29, at the Mount Elizabeth Hospital in Singapore where she was taken for better medical treatment.

A total of six people -- Mukesh Singh, Vinay Sharma, Akshay Kumar Singh, Pawan Gupta, Ram Singh and a juvenile -- were convicted in the gang rape and murder of the paramedic student here.

The President has already rejected the mercy petitions of Mukesh, Vinay and Akshay. While Ram Singh had committed suicide in jail, the juvenile was released from custody after completion of his term.

Pawan Gupta ki unna 2 options lo one fasaked... So left is last One thats mercy plea with president once if gets rejected they give max 15 days for any other appeals if any else its time....

President Ram Nath Kovind rejects convict Pawan Gupta's mercy plea. Earlier, the Supreme Court has dismissed the curative petition filed by Pawan Gupta. Mercy petition of the other three convicts Mukesh, Vinay and Akshay have already been dismissed by the President. The SC also rejected Pawan's application seeking stay on the execution of death sentence. The trial court had issued fresh date for execution of death warrants on 3 March for all the four convicts Mukesh Kumar Singh (32), Pawan Gupta (25), Vinay Kumar Sharm (26) and Akshay Kumar (31).

As all legal ways exhaust one-by-one for Nirbhaya gangrape and murder convicts, time of their hanging comes closer. Preparations are on in Delhi's Tihar Jail to hang Mukesh Singh, Vinay Sharma, Pawan Gupta and Akshay Thakur at 6 am on Tuesday (March 3). Pawan Jallad, the hangman who is to carry out capital punishment conducted a dummy execution in Tihar Jail on Monday. The dummy execution was carried out just after the news broke that President Ram Nath Kovind rejected Pawan Gupta's mercy petition. Clock ticks for the convicts and time for their hanging draws closer.

Pawan Gupta got a double blow on Monday as Supreme Court dismissed the curative petition and his mercy plea with the President was rejected.

Pawan, in the curative plea, had urged the top court to commute his death penalty to life imprisonment, besides seeking a stay on the execution of black warrant issued by the trial court.

His lawyer argued that he was a juvenile during the time of the commission of the offence, and the death penalty should not be awarded to him. Singh also sought a stay on the execution of the black warrant, on the hanging, issued by the trial court.

He is the only convict who was yet to exhaust all legal remedies -- curative petition, which is the final legal remedy available, and the filing of the mercy petition before the President.

Speaking to media persons, Singh had said there have been many errors in the previous judgements and he expects through this curative petition those errors are amended. "Our main contention is that on the time of the commission of the offence, Pawan was attending a musical programme", said Singh.

The top court had earlier dismissed separate pleas filed by Mukesh and Vinay challenging the decision of the President to reject their mercy petitions. Akshay is yet to challenge the rejection of his mercy petition.

 

 

On December 16, 2012, a 23-year-old physiotherapy intern, who came to be known as ''Nirbhaya'' (fearless), was gang raped and savagely assaulted in a moving bus in South Delhi. She died after a fortnight.

Six people, including the four convicts and a juvenile, were named as accused. Ram Singh, the sixth accused, allegedly committed suicide in Tihar jail days after the trial began in the case.

The juvenile was released in 2015 after spending three years in a correctional home.

BREAKING: President Kovind rejects convict Pawan's mercy

President Ram Nath Kovind has rejected the mercy petition of Pawan, one of the convicts in the Nirbhaya rape and murder case. Earlier in the day, Pawan's curative plea was rejected by the Supreme Court earlier in the day. The court had earlier in the day dismissed Pawan's and Akshay Kumar's Singh's applications for staying their death warrants.

Pawan's Lawyer AP Singh moved court on Monday saying that he has filed a mercy plea and execution ought to be stayed. In the hearing, the court pulled up Singh saying, "You are playing with fire, you should be cautious" and added "one wrong move by anybody, and you know the consequences."

Nirbhaya case: Convicts’ hanging on March 3 deferred till further order

A court in Delhi on Monday again deferred the execution of the four convicts in Nirbhaya rape and murder case, slated for Tuesday, till further orders.

"Despite stiff resistance from the victim's side, I am of the opinion that any condemned convict must not meet his Creator with a grievance in his bosom that the courts of this country have not acted fairly in granting him an opportunity to exhaust his legal remedies," Additional Sessions Judge Dharmendra Rana said.

I am of the opinion that the death sentence cannot be executed pending the disposal of the mercy petition of the convict.

"It is hereby directed that the execution of death warrants against all the convicts scheduled for March 3 is deferred till further order," he added.

The four convicts -- Mukesh Singh, Pawan Gupta, Vinay Kumar Sharma and Akshay Kumar -- were scheduled to be hanged at 6 a.m. on March 3.

Gupta had sought a stay on the grounds that his mercy petition is pending before the President.

 

Pawan, the last of the four convicts to seek legal remedy or file a mercy petition, had moved a fresh application seeking a stay on the hanging as his mercy plea is pending before the President after the court dismissed their application seeking a stay on hanging earlier on Monday.

He filed the mercy petition after his curative petition was rejected by the Supreme Court on Monday morning.

During the hearing on the application on Monday, the court was apprised that the jail authorities are aware of the convict's mercy petition.

This game of hide and seek needs to be handled with a hard hand. This application is not maintainable," Public Prosecutor Irfan Ahmed said.

 

The case pertains to the gang-rape and murder of a 23-year-old girl, dubbed later as Nirbhaya, in the national capital in December 2012. Six people, including the four convicts and a juvenile, were named as accused.

Ram Singh, the sixth accused, allegedly committed suicide in Tihar jail days after the trial began in the case. The juvenile was released in 2015 after spending three years in a correctional home.
