USCIS Mistakenly Denied Over 100 H-1B Visa Registrations

Due to a glitch in its new registration system, U.S. Citizenship and Immigration Services (USCIS) mistakenly denied more than 100 – and possibly hundreds of – H-1B registrations filed for new H-1B petitions. In a cruel twist, it appears many foreign-born professionals were denied a chance at one of the 85,000 H-1B petitions available for new H-1B visa holders through no fault of their own.

Under the new system, an employer and, if represented, their attorney register a company and submit the foreign national’s name they wish to petition for an H-1B. USCIS received approximately 275,000 such registrations and then notified employers by March 31, which, if any, of their registrations were selected in the lottery. The lottery was held because the 275,000 registrations far exceeded the 85,000 new H-1B petitions allowed annually under U.S. law (a 65,000-annual limit and a 20,000 exemption from the limit for individuals with a U.S. advanced degree).

The new USCIS system erroneously denied many registrations as duplicates that were not duplicates. Disallowing duplicates is to prevent a company from sending in multiple registrations for the same individual as a way to improve the odds of being selected in the lottery. However, the USCIS computer system eliminated many legitimate registrations by mistake. (USCIS did not respond to a request for comment.)
