The proclamation imposes new restrictions on entry under the H-1B, H-4, L-1, H-2B, and J-1 nonimmigrant (i.e., temporary) visa categories, including those following to join an applicant.     • Individuals whose entry would be in the national interest, as determined by the U.S. government.
  • International students on F-1 visas are not affected by the proclamation.

The new proclamation extends this ban until the end of this year, to December 31, 2020, and possibly beyond.

In addition, the new Proclamation bans the entries of persons in the following visa categories:

  1. H-1b specialty occupation workers and their dependents.
  2. H-2b temporary workers and their dependents.
  3. L-1A managerial or executive capacity intracompany transferees and their dependents.
  4. L-1b specialized knowledge intracompany transferees and their dependents.
  5. J-1 interns, trainees, teachers, camp counselors, au pairs, summer work and travel students and all J dependents.

The Proclamation specifically applies to:

  1. Persons who are outside the United States on the effective date 6/22/2020;
  2. Persons who do not have a non-immigrant visa that is valid on the effective date;
  3. Persons who do not have an official travel document to the U.S. other than a visa, such as an advance parole, reentry permit, etc.

Beware, this suspension for H-1b’s, H-2b’s, L-1A’s, L-1b’s, certain J’s and their dependents DOES NOT apply to the following:

  1. Any legal permanent resident of the United States (green card holder).
  2. Any spouse or child of a United States Citizen.
  3. Any foreign national who comes stateside to provide temporary services essential to the U.S. food supply chain; and
  4. Any foreign national whose entry would be in the national interest as determined by the Secretary of Homeland Security
