This is because the INA requires unused family-based visa numbers from the immediate prior fiscal year to be added to the employment-based allocation (and vice versa). There was significant employment-based number usage in FY20 before the COVID-19 pandemic began, while in contrast there has been minimal Family Based number usage because of extremely limited consular processing due to the pandemic and the recent proclamation order. Hence, please be prepared to file your adjustment of status application with USCIS as early as October 1, 2020 in case your priority date becomes current in the October 2020 visa bulletin. Our office is prepared to handle the possible influx of cases while addressing each individual client. Also, please note that the change in USCIS application fee that goes into effect on October 2, 2020. As soon, as the October 2020, visa bulletin is released we recommend that you do the following: Schedule a medicals examination (Pls note that you can only submit the medicals either at the time of filing the application or when RFE is received. You would not have the option of attending medicals abroad in case you are travelling). Make sure to obtain your birth certificates. Complete the attached I-485 checklist and email it back to us along with all the supporting documents. Please don't hesitate to contact us if you have any questions. Thank you. When AILA last spoke with Charlie Oppenheim in July 2020, he anticipated that the infusion of unused family-based visa numbers could increase the FY21 employment-based allocation to at least 250,000 immigrant visas. To put that into perspective, FY20’s employment-based allocation is the second highest allocation of employment-based numbers in memory, at 156,000, with the highest being 158,000. THese are mostly international managers and will have more dependents. Using 1.5 dependents for each, its 57,500. We dont know how many applied in Q3, Q4 and in FY21. Based on all the data, there will be 0 spillover from EB1 to EB2 even after FB spillover. Now, Coming to EB2, I think it wont move the needle much. May be some time in 2010 by the end of FY21.
