Don't endi ante assuming u don't have 140 in New company old 140 belongs to old employer can the new employer use that to interfile not sure bro

AC21 rule says so new employer can use old l140 just he files 485j

but inter file also almost same.

I’m also in same situation but finally decided to be same employee to avoid unnecessary delays and hiccups

take it with grain of salt..no law requirement. its personal choice to switch. very few does. if you are able to justify change later if some one asks at citizen interview.. employment is at will so its not a big deal. if you see 30-50% raise in sal and position yes.

so far most I have seen waited for min 3-6 months to be in safer, USICS is unpredictable and admin, you never know what will be policy at that time. don't listen to Buffon Teddy advise you can flip burger next day.

@chicagoafdb pls suggest whether interfile or refile is good option ? Looks like SRC is not moving at all.. since they are following random order so is the concern..refiling can get to NBC atleast correct? Pls suggest

Bro seen two cases first hand. if your application is stuck at SRC /  LIN, even you file new application, right after bio ( if not completed, talking about 2020 ) they are routing from NBC to SRC / LIN. there will be outliers, very few cases refile will be at NBC. Don't know what is the success rate. we have seen with out interfile USCIS approving in EB2.  

So its purely luck. but 2 cents, since USCIS announced Interfile, they may approve some cases zigzag and will say done a good job.. If i have to do some thing it will consider interfile..not advising you to do, giving a reason why I would.

Risky, but if you are not dependent on GC EAD, on H1 stable contract / Job. I will go and check if we can withdraw EB3 AOS for good, and then file a new application with EB2 if my FAD is current. chances are more new application will be at NBC and get processed. Don't know if any one considered this option here..
