At that time i140 is not ready with new employer. Now I got my i140 in eb2 with new emoployer as PD 0514

So options for you (sorry for being practical) the safest and accepting the things they are so you will have peace of mind

1) Assume you till will be in eb3 and continue working on it as you got ead and 140 approvef you are safe you will be missing chance for eb2

2) request client ti wait for 6 months you can interfile this week and wait for 6 month and jump (I am in same situation trying to save my job for 6 months)

3) If you think that offer is great and you get lot of hike etc just take it and be on eb3 also explore the option if the new client can file new 140 in eb2 just in case if we need in the future (Not sure how this works)

I am not sure whether staying on EB3 is a good idea as these dates may go back in October and we may never even get them back in the short term.. I want to interfile or file 485j to switch lanes to EB2.. I was under the impression that we can do it with I485j with the new employer...

I don't think any offer is worth jeopardizing the chances of getting a GC (even though we have an EAD)..looking at friends who waited for nearly a decade after getting their EAD.. 

Any idea whether interfiling requests are being approved? Anyone got GC's after doing interfiling? I will probably ask the client to wait for 6 more months to convert to FT.. Are you also planning to switch jobs?

So far no interfiling request has been apporved bro some  say they sent with in a week i think its just coincidence some officers auto approved ( meaning they say saw eb2 and they approved in eb2 category few rare lucky)

Yaa my companyt is not doing that great i was planning to in april but this came up so waiting i interfiled 2 weeks baack

Bro, don’t switch to EAD if possible.. stay on h1.. this EB2 and EB3 dates can go sideways and you will be stuck in one category or even go back in the queue..

Did you get any response for the interfiling request? I have a feeling that uscis will take months or may be years (like the downgrade applications) to look into these interfiling requests..

if u used ead and moved to new company hyou cannot interfile ( filing new eb2 not sure thats a option its 18 months thing to get labour approved also not sure thats a option )

So ala ayithe, inka h1 transfer to new company petukoni i-485j file chesi kuda waste ae, based on Thokalee attorney "they cannot ask USCIS to transfer the pending I485 from EB3 to EB2" , ayithe check mate aa? inka current aye varaku inka same employer aa?

bhaya, ipudu kotha company ki h1 transfer petukuna, they cannot interfile kada? based on what your attorney said, you will always be in EB3 if you move to new company irrespective of h1 transfer or use your eb3 ead. so basically check mate with employer

485j will transfer the pending application from one employer to another… but cannot change the category.. new employer cannot request for interfiling.. they can apply for a new I485 but that will put you back in the queue (not sure if you have to file new labor and 140 in this case)

Yes a big big difference if it goes to national benefit cneter (msc) last year that was the main difference
