485 (GC), Ead , AP, Spillover issues

I think there needs to be some clarity on what National Benefits Center is. At its core, it is just a collection of field offices and by volume prints most of the green cards, ead/ap and approval notices. It is headquartered at Lee Summitt, MO. When your case is initially assigned to the NBC by the lockbox, All of the physical files you sent are sent over to the NBC and they are scanned into the system at the NBC. The game starts only when you complete the biometrics. Your processing is done at the field office level so the time line is based on how busy the local field office is. The processing times are an approximation. Not absolute. Think of it as going to the post office. The people at the post office take your parcel and give you the receipt. They will then put it into the bucket behind them where the other postal workers take and process. Here each bucket corresponds to the field office and Post office is NBC. When the NBC is processing your case, it will put it in the appropriate bucket for the field office to use. The biometrics process send your prints, name and picture to be matched against Federal, Inter-governmental and state databases and FBI for a match. They will check for any smuggling, trafficking, economic, international lookout crimes, no-fly list, global economic crimes, terrorism, or on any no-fly/dont allow in list etc against your name and picture. Once they complete that, then your records are checked against Federal and state databases for incarceration, DUI, economic, fraud, sexual crimes including past convictions etc. It is only after this process completes that the game starts. 

Once the biometrics come clean, the agents at the NBC will start the cursory review of your application. What they are looking to do is identify the obvious things that are missing. Things like birth certificate, marriage certs, Proof of previous status, I-94 etc etc. The NBC will send you an RFE if anything is missing. Anything you provide to the NBC is scanned and added to the case. The physical papers are kept with your case. The goal is to make your case documentarily complete. As you respond to the RFE, provide clarity, your case becomes closer to being documentarily complete and ready for adjudication. Once your case is documentarily complete and your priority date is close to being current, the NBC will transfer your case electronically to the field office associated to you. This will usually be the field office closest to the address you mentioned in your I-485. Sometimes if the field office closest to you is super busy, they may divert your case to another office. 

Once your case is at the field office, it sits there till an officer at that field office picks it up and assigns to himself/herself. It is to be noted, that decisions on I-485 are made at the field office level not at the NBC. The NBC is only a processing agency, not an adjudicating one. There are limited field officers at any field office. They are also adjudicating family based, spousal cases etc. Once the cases come into the field office, they are partitioned and assigned to different officers at the field office. When the officer actually touches your case depends on your luck because like all humans, they will also have existing loads to work on, vacation days, holidays, sick days etc. When they pick up your case eventually, they will review the case. This can be done in one shot or over multiple days. If they find anything missing in your case, you can get an RFE from the field office as well. Make sure you respond right away because your case is at the field office and you are very close to a decision. Once the officer at the field office has reviewed your case, he/she can make 1 of 4 decisions: 

1. Approval - Everything in your case looks good. The officer will electronically approve your case. What this process will do is assign a visa number to your and your dependents from the bucket of visa numbers for the month. It will mark those numbers as assigned and decrement the numbers at the Dept of State visa control by that number. This process will also send back info to the NBC at Missouri to print your approval notice and cards. You will see multiple statuses on your myUSCIS related to this - Ordered New card, Approved, USPS picked up mail, Mailed your card, and finally Card delivered. Thats the workflow. 

2. RFE - If the officer finds something missed by the NBC during the initial check, they can ask for additional documents through the RFE process. Look at the envelope and the RFE. If it has your local field office address, make sure you respond right away so they can process your case and issue a decision right away. 

3. Interview - The request for interview always comes from the field office not the NBC. If the officer needs clarifications on your case and something needs explanation, you will receive a request for interview. Make sure you fully prep your case and attend the interview. It is nothing to be feared but be prepared. Once the field office issues a notice for interview, your physical files will be mailed to the field office. 

4. NOID or Denial : If there are components of your case or your interview tanked really badly and if the officer finds something in your case that points to fraud, he/she can issue a Notice of the Intention to Deny (NOID). You can appeal the NOID and provide information. However if you can a denial notice, it means your application does not qualify for the immigration benefit you are seeking. 

This is the general process that happens. I highly recommend all of you sign up for the USPS Informed Delivery. What this does is send you pictures every morning to your email of the physical mail coming to your mailbox. As soon as your case is approved by USCIS, you should start seeing activity in the USPS informed delivery packages section. Please reach out if you have any questions. Good luck everyone !
