Supreme Court Dismisses Andhra Pradesh Allegations Against Justice NV Ramana

Chief Minister Jagan Mohan Reddy had claimed that Justice Ramana was working against the elected government in Andhra Pradesh and in favour of the opposition Telugu Desam Party of Chandrababu Naidu.

The Andhra Pradesh government's complaint against Justice NV Ramana was dealt with according to the "in-house procedure" and stands dismissed, the Supreme Court said today, indicating that the matter was investigated internally by judges. Justice Ramana -- the most senior judge in the Supreme Court after the Chief Justice of India -- was named by Justice SA Bobde as his successor this week. Justice Bobde retires on April 23.

In a short statement, the Supreme Court today said: "A complaint dated 6th October 2020 sent by the Chief Minister of Andhra Pradesh to the Supreme Court was dealt with under the In-House Procedure and the same, on due consideration, stands dismissed."

The court also added that, "It be noted that all matters dealt with under the In-House Procedure being strictly confidential in nature, are not liable to be made public".

In his letter, which became public later, Chief Minister Jagan Mohan Reddy had claimed that Justice Ramana was working against the elected government in Andhra Pradesh and in favour of the opposition Telugu Desam Party of Chandrababu Naidu.

As evidence, he had cited the judge's order to expedite pending prosecution against legislators from the ruling YSR Congress.

The judge, Mr Reddy also alleged, was colluding with High Court judges and they were acting at his behest.

A number of petitions were filed in the top court later, demanding the Chief Minister's removal in view of his allegations against a sitting Supreme Court judge.

Comments But the court had dismissed demand, along with the call for investigation, saying, "What is the inquiry to be made when the letter has already been in the public domain? The problem is when you read something in a newspaper and file a petition with all kinds of prayers".

CJI Bobde on Tuesday recommended the name of Justice Ramana to take over as his successor after his retirement on April 23, 2021, while also dismissing the complaint by Reddy against the sitting judge.

The Supreme Court of India has dismissed the complaint made by Andhra Pradesh Chief Minister YS Jagan Mohan Reddy against sitting Supreme Court judge, Justice NV Ramana in connection with the Amaravati land scam.

According to a statement released by the Supreme Court, an in-house procedure was followed to look into the allegations made by Reddy and the complaint was dismissed after due consideration.

"A complaint dated 6th October, 2020 sent by the Chief Minister of Andhra Pradesh to the Supreme Court was dealt with under the In-House Procedure and the same, on due consideration, stands dismissed," the statement said.

All matters dealt with under the in-house procedure being strictly confidential in nature, are not liable to be made public, the statement added.

Reddy had written to Chief Justice of India SA Bobde on October 6 making certain allegations against Justice Ramana. Subsequently, Reddy made these allegations on affidavit before the top court.

CJI Bobde on Tuesday recommended the name of Justice Ramana to take over as his successor after his retirement on April 23, 2021 while also rejecting the letter complaint by Reddy against the sitting judge.

New Delhi: The Supreme Court has dismissed Andhra Pradesh chief minister Y.S. Jagan’s complaint against Supreme Court judge N.V. Ramana, next in line to be the chief justice of India, saying an in-house inquiry had been conducted into the allegations.

According to LiveLaw, the court issued a statement which said the complaint, received on October 6, 2020, had been dismissed and that all matters dealt with under the in-house procedure are confidential and are not liable to be made public.

The statement came just hours after reports said that Chief Justice of India (CJI) S.A. Bobde has recommended Justice N.V. Ramana, the senior-most judge after him, as his successor and the 48th chief justice of India. His decision is in keeping with convention and norms of seniority.

CJI Bobde, who is set to retire on April 23, 2021, has sent the recommendation to the government and handed over a copy to Justice Ramana, news agency PTI reported. As per norms, a written communication from the incumbent Chief Justice is sent a month before his retirement.

If the recommendation is approved by the government, Justice Ramana will take charge as the next Chief Justice of India on April 24, 2021. He is set to retire on August 26, 2022. CJI Bobde’s recommendation, which marks the start of the process for appointment of the next Chief Justice of India, will be forwarded to the President by the government for approval.

Jagan’s complaint formally accused a sitting member of the higher judiciary of political bias and even corruption.

Born on August 27, 1957 in Ponnavaram village of Andhra Pradesh’s Krishna district, Justice Ramana was enrolled as an advocate on February 10, 1983. He was appointed as a permanent Judge of the Andhra Pradesh High Court on June 27, 2000 and functioned as acting Chief Justice of the Andhra Pradesh High Court from March 10, 2013 to May 20, 2013.

Justice Ramana was elevated as the Chief Justice of Delhi high court on September 2, 2013 and was elevated as a judge of the Supreme Court on February 17, 2014.
