Need suggestion on I 140 filing

Master bro.. 

Also, FTE.. So company is not agreeing to file two at the same time.. they are okay to downgrade it when its needed but i ll have to bare the expenses.

Oh at least good , may be valaki message clear ga ardam ayinda that you will bear the expenses for the second one now ???

@csrcsr  job description lo Ms unte, not sure they can file two same time.. also your friend applications filed same together with original PERM ? any idea about job description.. how come our attorney never mentioned it will be an issue. now @Podrick put me in dilemma..to take risk or not or stick with one category...

A job jd was like masters or more experienced cookie cutter for eb2 he got approved for both first hand info

I would do it in EB2. 

 

Reason: you can't file probably for rest of the fiscal year. you will have an opportunity to file in EB2 (or EB3) in October 2021 and possibly get greencard before Sep 2022 (if all goes well). 

If you go with EB3, May be your FAD would be current sooner but that doesn't necessarily mean you will get your Greencard sooner due to processing times. Once you file AOS, the only thing that is dependent on FAD is final step of issuing Green Card. Everything else will continue at the same pace even if your FAD is not current. 

If we have a lot of vertical spillover next year (which, I am hopin we will), EB2 can catch EB3 atleast until your PD.

do u have recent H1 ? - until when is it valid. or any renewal coming up .?

everything depends on how early u need EAD.

if u have enough time on H1 or renewal is coming up, I would go with EB2,  and then downgrade to EB3 if dates are not moving.

Feb 2013 FAD shud still be valid for another couple of years..unless something screws up the numbers. the screw up would still be by EB2, which u already are in.

True, H1 renewal pedda matter kaadu emo as he has earlier 140 justeb2 has advntage of downgrade (in case his company supports)

renewal ayyaka kuda elago H1 vadtad kada...so EAD techukoni labham ledu kada early ga ani by risking his EB2 EB3

Yes, They got that ... valle cheppaaru.. first application we will pay.. but for downgrade you will have to pay both lawyer and application fee annaruu...

Keep chasing eb2 

In this way worst case downgrade hassle untadi but you are not loosing any oppurtunity 

Eb3 lo unte if they don't accept filing dates in near future niku eb2 option undau but downgrade hassle undadu

Weigh in both options ultimately you gave to decide and stick to that plan  hoping it works good luck bro , tricky days

Yes, last month itself got the approval for next 3 years. Company said they are doing it in EB2 and if i want i can downgrade later on my own expenses.

thanks bro... for now i have decided to go with EB2 and if needed i will downgrade it. And lawyers here also been doing for other applicants and suggesting me the same.

Bro, just an FYI :

spoke to my attorney about upgrade or downgrade based on the needs.. She said it takes the same effort in my case for both upgrade or downgrade and she doesn't think one process is easier over the other. 

To simply put, Upgrade or downgrade both are same. (This is in my case again - I have master's and enough experience to file in EB2)
