6th yr H1B expires, 140 still in Progress

My Wife's H1B 6yrs will expire in Jan 2022, she is an FTE . 140 process is still in "Prevailing Wages" phase (should be approved this month). July lo PERM file cheste, i doubt if she gets her 140 approved by Jan'2022 which is less than 7 months. Covid valla Processing times are taking longer than usual.

I will file H4 from my end, are there any other alernatives or options.

 

Please suggest.

Don’t complete the 6 years here in US... at least have 3 months of time.... Ask her to go to India and she can later reclaim those days if needed... 6 years complete aipote she cannot get 140 approval..

check how much she was out of US during last 6yrs and you can reclaim that period post Jan-2022. If possible, see if she can stay outside US from now until Jan-2022 so you can reclaim that time. As always, consult good immigration lawyer for 20min call and decide future course of action.

Calculate out-of-US time from passport stamps and/or I-94 travel history online and not from “memory” because USCIS needs those pp stamps or i-94 history,

Out of India is an option, but India lo situation is not good and travel restrictions kada..so looking for alternatives

Yes i do, i just started H4 but looks like it is taking almost 11-13 months on an average. Can she stay on H4 Receipt

I have a call shceduled with my Immigration lawyer in next couple of days, posted here to see the options others can suggest

Go out of the country when 2 months is left and then when its time to apply for 140 come back into the country and do it in Premium ...

If your perm is done for more than 365 days you get one year ( 7th year) extension  . I-140 approve ayite you get 3 years extension . Don’t panic .  Talk to your attorney .
