Big Win for L-2 and H-4 Work Authorization!

A settlement was reached in litigation involving H-4 and L-2 EAD delays that will provide relief for the many people who have been waiting for their EAD cards. AILA and its partners brought the litigation against DHS arguing that they violated the law with the unreasonable delays in adjudicating EAD applications for L-2 and H-4 visa holders.

As a result of the litigation, DHS agreed to issue policy guidance that will allow people in L-2 status to work without needing an EAD card, stating that the law allows them to work based upon their status alone. In addition, DHS will provide automatic extensions of work authorization for L-2 spouses who have timely filed their EAD renewals. H-4 dependent spouses who filed their EAD renewals before they expired and have a current I-94 document showing their status as H-4 will also get automatic extensions of work authorization. DHS will issue further guidance on implementation, and we will provide it to you as soon as we have it.

We have been partnering closely with AILA on this and other advocacy efforts that impact our community and will continue to find opportunities for meaningful change in the immigration system.
