GC DOF Question

Hi ,

 

My Priority Date is March 2014 EB2 . Oct 2020 lo I filed for downgrade and I and my wife got our Combo EAD cards.

But my I140 has no action on it .

Now when the DOF is Sept 2014 , will I have to interfile ?

Since my EB2-EB3 Downgrade hasn't completed with I140 still EB2.

Any suggestions on what i should be doing .

you cannot interfile as Eb2 SEP 2014 dates are only Filing dates not final action dates.

final action date current aithe - appudu you have to send a request to consider eb2 instead of eb3. 

For this your downgrade should have been a new eb3 application rather than ammendment to your eb2 140.

If your employer amended your eb2 140 - then you will have to file a new eb2 140 and then do either interfiling or new 485 at that time.
