H4 I94 extension in Mexico

Hi All,

My H1 stamping is expired but I have a valid i-797 until 2025. My wife's h4 and ead expires soon and she has a valid visa stamping.

1. Can we fly to Mexico?

2. Will I be requiring a Mexican visitor visa?

3. Will it a problem if I travel and come back under AVR? (as I don't have valid H1 stamping)

1) Yes, you can fly to.

2) on arrival visa will be given if us stamped visa expires with cash.

3)AVR is valid per website only for land travel but i have seen in many forums they did fly also so i would say its your luck if you want to fly.

Yes you can

No visitor visa for mexico at airport some on arrival

Automatic revalidation should get you in

But make sure your fly and make it little purpose full trip like a vacation etc for 2 or 3 days no issues , at POE show the officer your I 797 and request for 94 extension to match your 797 valid date , many guys had success with it ( so that your wife h4ead can be automatically extended 180 days)

Good luck take all documentation,  also tell if it's small attorney tell him to attend your call just in case any issues

It will work bro

Thanks for your response. I've read on some forums that flying has better luck.

So I might get visa on arrival at the airport. Planning for 2-3 night stay at cancun or something and make it look like a trip rather than same day event.

Any documents other than our approval notices, receipt notices etc.
