Waterloo student, 21, was attacked, kidnapped, stripped, humiliated

KITCHENER — The crimes were horrific and inexplicable. 

A 21-year-old university student from India living in Waterloo was knocked unconscious, kidnapped, taken to a townhouse basement, stripped naked, humiliated and kicked in the face multiple times.

The assailant, Panyar Asouth, 28, filmed five short videos of the attack. He pleaded guilty this week in Kitchener court to kidnapping and will be sentenced in January.

Asouth, who came here as a Sudanese refugee in 2003 and is now a Canadian citizen, told the victim: “You don’t belong here. This is what you deserve.”

The Crown and defence say the attack was not racially motivated. Asouth was drunk and randomly attacked the man. They had never before met.

Two other men were implicated. One pleaded guilty to theft; charges against the other were withdrawn.

Last Sept. 16 at 10:15 p.m., the student was walking through his townhouse complex on University Avenue East when he saw two people fighting.

“As he passed them, he started to jog,” Crown prosecutor Jane Young said in court, reading from an agreed statement of facts. “Before he knew it, the two males caught up to him and ripped off his backpack and took his cellphone from him” while he was talking to a friend.

 

His friend heard him yell for help. He went to the townhouse complex and saw Asouth and another man carrying the victim by his arms and feet. The man heard his friend begging them to let him go.

The victim was then kicked and punched and lost consciousness. Asouth told the victim’s friend to leave and began walking toward him. The friend ran to his townhouse and called 911.

The victim awoke in the basement of Asouth’s nearby townhouse.

Asouth punched him in the face and head and choked him to point where he could not breathe “and thought he was going to die,” Young said.

That’s when Asouth told him: “You don’t belong here. This is what you deserve.”

The victim was then stripped naked.

Police found five videos of the attack on Asouth’s phone.

In one video, Asouth threatens to kill him if he moves. In other videos, he humiliates him. He kicks the man in the face multiple times.

Asouth and the victim were alone in the basement during the attack, which lasted 10 to 15 minutes. One of the co-accused later gave the victim some clothes, prevented Asouth from continuing the assault and told the victim to leave. He ran out the front door.

The victim was taken to Grand River Hospital

“He had two swollen cheeks, swollen lips with dried blood, his right eye was red with bruising around both left and right eye, he had blood dripping around his left ear and a one-inch cut to the side of his head,” court was told.

“His sinus bone was cracked during the assault and he had to see a surgeon.” He also had a chipped tooth.

 

The man returned to India to be with his family “as he no longer felt safe here in Waterloo Region,” Young said.

Several items were stolen from the victim, including a laptop which contained all of his university school work and “sensitive information for a startup that he had been working on.”

Police arrested Asouth and the two co-accused on University Avenue East.

Asouth was charged with kidnapping, forcible confinement, assault causing bodily harm and robbery. The latter three charges will likely be withdrawn after he is sentenced.

The Crown and defence lawyer Sean Safa are recommending a four-year sentence. Asouth will be sentenced in January. By then, he will have served the equivalent of two years in presentence custody.

If Justice Craig Parry agrees to the joint recommendation, Asouth will have another two years less a day to serve in a reformatory.
