Jagan getting ready with new 3-capitals bill

YSR Congress party government in Andhra Pradesh led by chief minister Y S Jagan Mohan Reddy is learnt to have commenced the exercise for bringing in a new legislation for the formation of three capitals for the state shortly.

According to reports in a section of the media, the draft legislation on the new bill on decentralised development was prepared and is presently under thorough scrutiny of the legal experts and the law department.

Once the process is over, it would be approved by the state cabinet and the bill would be introduced in the state legislative assembly and council for the approval.

“In all probability, the state cabinet will clear the bill in a week or two and it would be introduced during the winter session of the state assembly,” sources said.

It appears the revised three capitals bill is being drafted in such a way that it would not jeopardise the state government’s argument in the Supreme Court challenging the March 3 high court judgement.

While the Supreme Court granted stay only the time-limit fixed by the state high court on the construction of Amaravati, it did not completely dismiss the argument in favour of Amaravati as the only capital.

Moreover, the state government’s counsel in the Supreme Court clearly told the court during the course of arguments that as of now Amaravati stands as the capital, though he did not say the only capital.

So, the revised bill would also be on the same lines – developing Amaravati as the capital (though it wouldn’t say the only capital), but would talk about decentralised development with high court at Kurnool and Secretariat at Visakhapatnam.

“In all probability, the bill might not mention about the three capitals as such, but would focus on decentralised development. On paper, Amaravati would remain the capital, but the administration might operate from Visakhapatnam,” sources said.

The new legislation would also mention all the commitments made for the farmers of Amaravati like development of their reconstituted plots and payment of annuity till the agreed period etc. 

Since the Supreme Court has granted stay on the time limit for the same, the Jagan government doesn’t have to be in a hurry to develop the plots and complete constructions immediately. It will take its own time to do that.

There is no clause in the agreement signed by APCRDA with the farmers that Secretariat should be there only at Amaravati, they cannot insist the same in the Supreme Court, as the proposed bill might say the capital will remain at Amaravati to remove all legal hassles, sources said.
