They will have an option weather to choose it or not based on case history, their own experience, case's merits, personal sentiments, some sort of taboo,

for ex., 

1. If the Judge is hard-core blood & breed Royal Pulka, they would not even like to hear anything wrong against Pulkas. 

2. If the Judge is Beggarseema Cheddi, he will obviously make sure Dramoji count the jail bars, so a Co-Pulka Judge will raise objections against this Cheddi Judge there by hitting on future promotions of that Cheddi Judge

3. If the case is related to child rafe which is allowed in Islam (as a muslim you can rafe/kill a Khaffir woman even if she is child), so neither Muslim Judge nor Hindu Judge will feel comfortable dealing the case, in which case it goes to a non-religious Judge etc.
