Hello db,

my cousin has 140 apprvd longtime ago, he has an offer from his company to go canada to work there for 2yrs and he would like to get back to US after.
question- when he gets back, can he get back with H1 applied using same 140 or does he have to fall in queue with new H1s/lottery?

please help,

Okka sari I-140 is approved for more than 180 days, it stays alive forever. Meaning that I-140 can be used for later H1B extensions/H4EAD. So no need for h1b lottery.

Neeku okka sari h1b meda pani chesaka and I-140 approve ayyi unte, you can go to india for 3-4 years. Then if a company files h1b for you and get visa stamp in India, you can come back to US.
