Telangana govt to regularise notarised property deals, eyes Rs 2,000 crore revenue

In a major move that will end the decades old issue of property transaction on notarised documents, the state government will soon release modalities to regularise them.
The decision is likely to benefit nearly six lakh people in the state especially in Greater Hyderabad as well as net the government Rs 2,000 crore by way of regularisation fee.
Notarised property transactions are done on a stamp paper attested by a notary advocate instead of actually registering it. This is legally not valid and cannot be transferred to others and even GHMC had stopped assessing property tax on such properties a few years ago as people were registering them using property tax receipts. These illegal property transactions has also resulted in huge loss of registration revenue to the state government over the years.


Official sources said a majority of these transactions are from the Old City areas of Hyderabad, slums and old settlements in Secunderabad such as in Begumpet, Manikeshwari Nagar, Addagutta, Quthbullapur and other thickly populated areas, Pahadishareef in Ranga Reddy, Dammaiguda and other places in Medchal-Malkajgiri district.

The cabinet sub-committee has already asked collectors to identify locations where the problem is acute. The issue has been raised by political parties on several occasions, especially by AIMIM floor leader Akbaruddin Owaisi in the assembly.


Sources said revenue officials are working on the kind of transactions on notarised documents that will be allowed and the fee. If fee is collected, it is yet to be decided whether it will be through revenue or registration department. However, the government does not want to regularise plots on lake beds and open places as was done in GO 59 (encroached government land).


"The notarised documents issue has been there since 1970s and people have been asking the government to resolve it," ex-MLC Syed Aminul Hasan Jafri told TOI.
He said the government should collect 10% of total value as one-time fee and the applicant should be offered regularisation of his building, LRS, property tax assessment etc., all in one go.


Officials said people opted for notarised documents instead of registration for multiple reasons. Often the poor used it to avoid hefty stamp duty for small properties. Also, with houses being very old, the sellers would not have documents in many cases. This issue was more in the Old City, officials said. Moreover, some people including politicians encroached upon government land and sold them as plots using notarised documents. These layouts have come up even in full tank level of lakes, buffer zones, parks etc. Then there are notarised properties which are disputed land where the registration department denies registering them.
Following the government's plan, there are now demands from rural areas to regularise notarised property transactions on the lines of Sada Bainamas (transactions on plain paper) by registering them without any fee.
