URGENT - i thommidhi naalugu - please help

Hi Friends,

1. My previous  I-797 is going to expire by 05/10/2023.

2. So, Employer applied new I-797 in Jan, 2023 and approved in Feb, 2023.   But the new I-797 is valid from April, 2023 to April 2026.

3. in March 12, 2023 went to India and returned to USA on March 23, 2023 in 10 days.  

4. at entry , I gave new I-797 to officer. He asked me why didn't go for new visa stamping, I said that I stayed only 10 days in India and could not get dropbox appointment.

5. officer didn't say anything and allowed me in. Today I just checked my latest i-94 ,  it is showing the old I-797 expiration date instead of new I-797 valid date. it is my mistake that didn't check before.  Have only 3 days validity now. I just sent email to employer attorney.  I am worrying about this. what are the options now to resolve this without going to India for new stamping.

You should be fine, as you have new I 797. The immigration officer put the date from the stamped visa. He is correct.

don’t worry as you have new i797.

Check with attorney as well!

nak same happened in dallas poe .. its pain in the ass to get that updated but I was able to get it updated . 

go to deferred inspection site in the nearest airport and they can fix it . DM me if you need more help

I797 is not valid document to enter US. They won’t change it. If they put incorrect date then they will.

yeah I see this option. until completion of this process, can we work with employer on h1b?

Mexico border daati evening kalla return ayipo they will give new I 94 validity

I have been in that situation baiyya . basically your i94 number is updated and your new i94 number determines your length of stay . ideally at poe you show latest i797 and visa and they give i94 until end of new i797 .
