I think, officer thinks that my new I-797 validity ( from April, 2023) is not yet started by the time of my entry ( march, 2023).  thats why he gave old i-797 expiration date. Is it true? any body has same experience?

I have been in that situation baiyya . basically your i94 number is updated and your new i94 number determines your length of stay . ideally at poe you show latest i797 and visa and they give i94 until end of new i797 .

Yes usually new i797 determines new validity not on visa.. Ala ela miss kottado officer

That makes total sense to me now.

Hi Friends,

1. My previous  I-797 is going to expire by 05/10/2023.

2. So, Employer applied new I-797 in Jan, 2023 and approved in Feb, 2023.   But the new I-797 is valid from April, 2023 to April 2026.

3. in March 12, 2023 went to India and returned to USA on March 23, 2023 in 10 days.

4. at entry , I gave new I-797 to officer. He asked me why didn't go for new visa stamping, I said that I stayed only 10 days in India and could not get dropbox appointment.

5. officer didn't say anything and allowed me in. Today I just checked my latest i-94 ,  it is showing the old I-797 expiration date instead of new I-797 valid date. it is my mistake that didn't check before.  Have only 3 days validity now. I just sent email to employer attorney.  I am worrying about this. what are the options now to resolve this without going to India for new stamping.

Don’t worry bro, your new I-94 is valid from its start date . Same thing happened to me in 2021. I had a stamping and I-94 valid through August and my company applied in March and got approved in March. Nenu June lo India velli vacha. Got a new I-94 till Ausust 2021 only. Maa attorney tho matladithe don’t worry starting August 16th your new one comes into effect. This might not reflect in CBP portal but u don’t have to worry

As someone said already, go to deferred inspection site, b4 going call them, sometimes they ask to email them and do it and sometimes they ask you to come to deferred inspection site, check your nearest site and reach them, they will do it in 5 mins

ISSUE resolved. Thanks all.

My attorney asked me to meet deferred Inspection officer to correct I-94. I just called deferred inspector to get appointment. But he asked my problem with I-94. I explained my issue , he simply updated my i-94 admit date to new i-797 expiration date immediately over the phone and that is reflected in I-94 now.
