Attorney filed Eb3 instead of Eb2

Friend’s I-140 approved at present in Eb3 category but need to refile in Eb2.

if the Perm is certified recently and the job requirments on PERM satsifies eb2 reqs he can use the same PERM and apply for eb2 , like most of us used the eb2 and did for eb3 downgrade during the covid time , just additinal fee but he will have both 140s but if this is his first 140 and his pd is 2023 etc its fine with eb3 as it is going to take long long timegood luck anna

Downgrade possible but upgrade is hard , esp so called big attorney will not encourage it unless you apply perm again.
