asking for a Frnd

 

He lives in US and owns an apt in hyd. His family members used to stay in his apt. There were some relationship issues among those family members (and also ended up in debt from many). One fine all family members jump (Agnathavasam) So this Frnd of mine kept the apt empty since then. Now one of the family members returned and took possession of the apt despite my Frnd saying NO. 

 

Apt is legally on my funds name and he wants to take it back in any case. What are his options.

1) Would police help if he files a complaint against illegal possession? (remember he is here)

2) Does he have to go through court system to get it back?

or any other suggestions.

First ask him to file a complaint in police station , check with a lawyer whether u need to there physically or through website...

Rental agreement lantidi emi lekapothey trespasser ani complaint ichi padey…depending upon the situation cops will let you know if they can evict with a warning or file a case in the court…

India lo police complaint ichi, civil court la chuttu tiragali .. rent kattaledani kali chepincgalante it takes years.. courts lo yrs yrs vayidalalo tipputaru.. only option is find some connection local police station lo lanchan ichi aa poluce ni pattukelli daggarundi kali cheyinchali. Nothing works. If That relative has stringer connections in police, sachave kalu cheyyadu inka.

Police wont do anything until u get a notice from civil courts to police to order them to go and get it vacated. Court lo case teladu. Yrs tiragali. Have seen many cases .. last ki vadito e elagola settle cheskuni pampincharu.

Talk to him and ask nicely to move out. These matters are better to sort out of PS and courts. Your friend can file a complaint in Police station and show ownership and that they have occupied. Since they are not paying rent, it should be an easy case in PS. 

PS ki pothe vallaki mamulu  etc .. so better pay some small amount and get rid of them.

Ikkada main issue, flat possession. If your friend has a trusted friend/relative, let him go to the flat, talk to them and try to sort offering little amount. If they leave, change locks immediately and put Security cameras. 

If they do not listen, threaten them with police complaint. If no response, let your friend file a complaint in local PS. You need contacts for these matters to move or at least presence is needed. Otherwise police will say "mee vodikee interest ledu radaniki, mammalni em interest chupinchamantav ani"

Another approach, when the person who occupied the flat goes out may be for a day or two. Talk to  your trusted friends/relatives and ask them to break lock, move their stuff into some storage, change locks and install camera. Let your friends stay in the place until it sorts out.

complaint File cheyadam possibility vundo ledo telidu but alanti facility vunna kuda its least effective. 

Does that house have any home loan on it ? That’s one the best way to secure the property…avasaram lekunna minimal la home loan teesukuni property ni mortage cheyandi…I know it comes with some cost but best way to secure rental properties.

Also utility bills on owner's name maybe?

If the squatters are occupying the place without your knowledge or consent and you have title registration, mutation and electricity bills on your name, police should be able to remove them without a court order. This is possible in agri lands where others are cultivating your land without your knowledge/consent/lease agreement - not sure about residential properties.

Utility bills will be on the owner name by default…honestly it won’t be of much help. One thing will help is the property tax in case of any litigation.

Always pay property taxes from the owner’s account. Any third person can pay the bills but it’s always advisable to pay property taxes and other taxes from Owner’s account. I’m case of any court litigation, this will have a good weightage to defend your claim.
