I think it’s better you move to H1. Since you never know how long court proceedings will take? Also you may not get your GC until it’s current again in future.

Amendment or new. New I140 filing with a expired perm is not correct and many filed in new got approval and may be revoked.

This will save you. I will tell you my case. I applied in both EB2 and EB3 separate I-485's. 

My EB2 approved properly. My friend also same case and his EB3 was closed properly by USCIS saying approved in other category. 

My EB3 never closed and even now it still shows pending so I consulted Rajiv Khanna [https://www.immigration.com/] asking if I need to contact USCIS/Ombudsman to request them to close EB3 as I have GC. He said they will do it themselves or incase GC is revoked you can always fallback on the open EB3 I-485. You do not have to do anything annadu.

For EB3, My online case status shows case is closed as benefits received by other means as I got gc approved in EB2
