H1B -> H4 -> H1B

Hello all, 

Need some direction related to my VISA situation.

1. Working full-time on H1B with my employer (VISA approved till 2025) and I-140 approved with priority date 2017.

2. Most likely will get fired by the end of this month (already had a discussion with management, but only the date is not confirmed) due to cost-cutting.

3 Within 60days new job is next to impossible, so planning on going H4 +EAD

So questions

1. Ippudu na wife naaku H4 apply chesthey, the moment H4 is approved (let's say mid of October? not sure about the processing times). I cannot work on my existing H1b from mid-October to the end of this month, right? So should I wait until the last week? 

2. Heard from one of my colleagues that he knows similar situations, where his friend got fired (h1b) -> moved to H4. 8 months taruvatha cleared an interview and the new company sponsored him H1b. he is working now with H1B. Ee process lo what kind of issues can we face? ( I did talk to my company and they are not planning on revoking my H1B)

3 Also Paina situation lo do we need to get H4 VISA stamped first and then change to H1B?

4 If  H4 -> H1B is totally possible, then nenu EAD apply cheyalsina avasaram ledu kada?

BTW ( We can manage with single pay for 3 - 4 months)

why not transfer H1 to consultancy...

Try some contracting role .. not difficult to find in 2 months and move to desi mestri 

if you start now you might have 2 and half months 

don’t think about billing now , just get a proj first then move to high billing

Sorry to hear Anna if you want to go h4 route this is summary afaiak

-  be on h1 till last date Work till last date of separation get your severance package 

- Apply H1 to h4 Change of status , the moment receipt comes you are within status (dont know the timeline for approval)

- mean time you will be searching job I am sure you can change back to h1with change of status without issue if your above h4 is approved but if its still pending dont know Anna contact attorney can you get back to h1 without status

No issues except the situation if your h4 is still penning can you come back to h1 or you can go out and get that stamped in worst case

yeah trying some contracting positions too (obviously pay rate is almost close to half of what I'm earning right now but its OK)

yeah, will talk to attorneys tomorrow to clarify H4 -> H1. and will check with them on what to do if H4 approval is still in pending state.

I did step 2 myself . No issues . I also got my GC . PM me of u want details

Thank you. Right now I have answers to my questions. But will sure PM you when I have anything else to clarify

 

Did talk to attorneys and yes as everyone mentioned.

1. Shouldn't be a problem at all for H1B -> H4 -> H1B

2 Even they suggested trying job hunt until the 60 day period is close and apply for H4 at that point ( I should be fine with legal status to stay even the apporval for H4 is still in progress) to avoid the switching overhead.

3. I'm in touch with some consultancies (pay almost going to 1/2 but absolutely fine for now) so hopefully will get placed for a short project until I get a full-time again.
