A gujju bela trivedi is not positive at all. mukul gadu vadinchalsindi kuda eme vadisthundi salve tho.. LOL

it seems its fixed already to keep cbn until elections. 

Murder case lone accused avinash teddy ki bail. money case lo no bail.. what a shame...

 

Looks like CBN will be in jail for another 3-4 months if bail is the only option.

Justice Trivedi : Last time you disappeared unceremoniously. Even if you are appearing virtually, you have to seek the permission of the Court to leave. You just disappeared.

Salve (appearing physically) : I apologise...

 

Salve says there were other lawyers also appearing for Naidu and that he got muted when the others started arguing.

Justice Trivedi : I was surprised, Justice Bose also.

Salve : High Courts are divided on this question. Some HCs have taken the view 17A must follow the date of offence, some other HCs have taken the view that 17A must follow the date of the FIR.

Salve : As I have seen in my practice in this Court, there is no hearing given to the opposite side on whether notice should be hearing. I don't understand pre-notice hearing. They are on caveat, of course, they can be heard on interim order, but not on notice.
Justice Trivedi : I have my own doubts if there can be a caveat in a criminal matter.

Salve: in this court caveat is permitted in all cases.

 

Salve : The complaint had nothing to do with the Petitioner. There was a company called Design Tech. Design Tech obtained GST credits from a company called Skill Tech or something. Justice

Trivedi : Agreement was with whom?

Salve : With State Govt.

Salve : The complaint relates to some GST credit which Design Tech took from Skill Tech.


Justice Trivedi : There are many contours of 17A. Offences are before 17A came into force. Subsequently, other public servants are added. So in that case, will 17A apply?

Justice Bose : The cognizance is of the offence and the not the offenders.


Salve : When you reach the public servant, qua the public servant, you need 17A.

Justice Bose : So in your line of argument, an offence is investigation and a public servant is found to be involved and at that stage you need 17A.

Salve : Yes.

Justice Trivedi : And if not taken, the entire investigation goes?

Salve : Yes.

Justice Trivedi : While interpreting 17A, we also should see that the main objective of the Act is the prevention of corruption. So we can't adopt an interpretation which will frustrate the objective of the Act.

Justice Trivedi : The allegation was that 10% was advanced.....

Salve : I have a limitation getting into facts...for others, HC has granted bail...anyway that is on facts..

Salve : In 17A, if I am right, whole thing goes, because the arrest becomes ilegal.

Question is correct kaani .. Ee case lo ani kaadu... Every case can be interpreted in the same way kada if you think from the other side and then also the purpose of 17A is defeated .....

I feel its complicated and I doubt if there will be a judgement anytime soon...

So at the max CBN might get some interim relief but not from the case...33mtnj.gif

LOL ..how else is the judge going to intrepret the act ? the act is primarily to prevent abuse of office while also ensuring investigations happen. You can investigate but take permision.

Intha straightforward law lo kooda judge wants to "intrepret". india is a joke - has always been.

Imo cbn ni ala arrest chesinanduku ap govt & cid ki mottikayal vesi investigation continue cheyyaniyyali. That will be win win for both parties.

cbn’s applications for bails in other cases got rejected. So ee case lo bail/quash aina short time loney malli arrest chestharu mostly.
