info regarding a property purchase

Hi bros, 

We want to purchase some land in Telangana but I want to know few legalities. Of course i will get a proper legal opinion from a lawyer in India later when the deal is about to finalize but prior to that we want to know whether we have to proceed or not. 

Scenario : Land we intend to purchase is in Telangana (80kms away from Hyderabad). Land is registered on a old lady name and her son want to sell the land to us . The old lady has purchased the land few decades ago. And there are no outstanding issues on the land.

The old lady has a daughter(married) too. The old lady and her daughter don't have good relations from last 10-15 years and they are not visiting each other.

Now the old lady and her son wants to sell the land to us and we are also very much interested in purchasing the land. But the old lady's daughter will not sign as they don't have good relations. However her son will sign.

Question 1: If we purchase the land with out the old lady's daughters signature …will we face any legal issues later from her daughter..?

Question 2: Do we need to get signature from minors (old lady's sons son i.e. grand son) also...if yes is that even valid by court..?

Not a safe situation, considering the daughter might ask for part of land once they sell it.

Ask the seller to have them convince daughter. 

Yes grand sons signatures are valid and should be encouraged.

Thanks for the info bro...please don't mind as i  am reiterating the question....grandson is a minor and his signature is valid in the court ...so that he cannot claim back his grand mothers property....is that what you mean to say ..?

Self acquired land of old lady ayithey she can directly sell to you with her son and grandson as a witness....3 months taruvatha ninnu evadu peekaledu...only if ancestral u need to worry about daughters...

One other option to prevent interference by daughters is to get the land first gift deeded to the son's children by the old lady as they are taking care of the old lady's living, hospital, medical expenses for the past 20 years (to be documented in the deed papers).....post 3 months u can buy from them........

Also post , for how much you are purchasing that land for? 1 acre = how many lakhs ?

As others said, she can sell the land since it is ancestral property.

Not to scare you but there is possibility, if daughter wants to create problem. In the end you will win in court but if daughter goes to court case will drag for ages. She can go to court with some stupid reasons like my mother was not in sound mind when she sold it, or we funded her when she bought the land, 100 such reasons..

How the old lady got the land .. did she purchased or she got from her parents

She purchase in 1990...and it is registered on her name .All records are intact.

There are possibilities bro...but trying to see how can we eliminate

If she bought by herself no issues … if got from someone or ancestors then she need her daughters sign

Old lady 1st valla abbayi ki raasthe asalu issue undadu .. also inka she is alive kabatti kuda em issues undakudadu

also old lady if she bought it by herself then her daughter will not have any right
