Reality Bro. For filing injuction order you don't need any solid evidence. Probable cause enough. Basically enough one with an iota of connection can file. Case drags forever.

She is not sound mind when she signed - if that is the reason where ancestral property thing come in to picture?

I know a case, where family member produced a note book claiming their father intentions are different. Case is going on for 10 years.

India lo Ilanti logic less land litigations chala vunnayi..

There are possibilities bro...but trying to see how can we eliminate

One possibility - if you can directly contact daughter see if you can get her to sign with small amount like 1-2 laks. Depends on their financial condition, it may work or backfire..

My take on land dealings - in India in general it is Risky. If you see even a small issue not worth taking risk.

The old lady has a daughter(married) too. The old lady and her daughter don't have good relations from last 10-15 years and they are not visiting each other.

If that old lady’s daughter decides to challenge the purchase in the future, it may create legal troubles. Although the chances of winning the legal battle is as good as zero but this may be used as bargaining chip for a settlement.

Secondly, If you are not a local to the area where you are buying the land or do not know someone who has clout in the area, you will definitely come across this type of trouble for sure if you are a NRI.

Finally, once you purchase this land that land will be yours no matter what happens as long as you are informed enough and has awareness about the frauds that happen and steps you need to take in those situation.

Ok bro, my mileage varies. All example I quoted based on experience of close family members.

In our experience after injuction order next court date itself will be in 3-4 months. If you were able get things solved in court in a month, probably our family might not be on not right path.

Hi bros,

We want to purchase some land in Telangana but I want to know few legalities. Of course i will get a proper legal opinion from a lawyer in India later when the deal is about to finalize but prior to that we want to know whether we have to proceed or not.

Scenario : Land we intend to purchase is in Telangana (80kms away from Hyderabad). Land is registered on a old lady name and her son want to sell the land to us . The old lady has purchased the land few decades ago. And there are no outstanding issues on the land.

The old lady has a daughter(married) too. The old lady and her daughter don't have good relations from last 10-15 years and they are not visiting each other.

Now the old lady and her son wants to sell the land to us and we are also very much interested in purchasing the land. But the old lady's daughter will not sign as they don't have good relations. However her son will sign.

Question 1: If we purchase the land with out the old lady's daughters signature …will we face any legal issues later from her daughter..?

Question 2: Do we need to get signature from minors (old lady's sons son i.e. grand son) also...if yes is that even valid by court..?

It’s the old lady property she can do what ever with it

Yes , my family resolved the land issue.. court nunchi injunction order vachindhi .. we have land details eveything good .. judge dismissed the case when the documents are good no one picking anything .. here in this case too .. the original owner undhi and bought the land with her miney so it is easy to resolve this issue as she don’t want to give land to her daughter

Yes bro...lady bought the land with her  own money....she doesn't want to give to daughter as they are not in good terms from last 15 years...

her son is willing to sign and to be on safe side we will take the signatures of her grandsons too...PS: grandsons are minors ...i am not sure how to take the signatures of minors ..is it even valid in the court of law..?

Hmm. Ok. Good know at least some cases get resolved on time. When documents are good what is the case then?

Avoid buying it. Even if the daughter can prove that money was funded by old lady’s husband blah blah.

Court will still up take up the case. I’m not saying it will work for them. But they can make your life hard.

valla problems tho Neeku sambandham ledhu. Andaru signs pedithe konta…lekapothe mingeyandiii cheppu. Kakruthi ki pothe be ready for some legal risk.

It sounds like you're offering some cautionary advice regarding a property purchase. It's essential for anyone considering such a transaction to be aware of potential legal issues. You mentioned that even if the daughter can prove the source of the funds, there could still be legal complications. It's crucial to be prepared for such situations, as they can indeed make things challenging. In cases like this, it's a good idea to consult with residential real estate management. They can provide valuable insights and guidance to navigate any legal risks associated with property purchases.
